1. The Data Controller

The Site is operated and managed by European Independent Purchasing Company Limited (“IPC EMEA”) whose members each operate a Subway® franchise business. In this Privacy Policy “IPC EMEA” will be referred to as “We” “Us”, or “Our”).  

 

The ‘controller’ of your personal data whilst using the Site is IPC EMEA. A ‘controller’ is a company that decides why and how your personal data is to be processed.  Please visit the following website http://www.ipcemea.org/ for further information on IPC EMEA.

Subway® stores are operated as franchises, therefore if you are applying for a role at a restaurant operated by a franchisee, your data will also be shared with and used by that franchisee for the recruitment process and that franchisee will be the data controller. As Subway® franchisees are independent operators, and independent data controllers, they autonomously decide how your personal data is to be processed and are solely responsible for compliance with the applicable data privacy laws in that regard.

2. Our legal basis for collecting and processing your personal data

Data protection requires that all personal data be processed lawfully, fairly and transparently. There must be a lawful basis for processing before any organisation can process personal data.  We use the following three scenarios as the legal bases allowing Us to legally process your personal data:

Consent: We collect, hold and process your personal data where you have given Us your prior, express consent to do so, e.g. by confirming your agreement during the registration process, to share applications with Subway® franchisees and to keep you up to date with new vacancies that may be suitable for you .

  • We set out what We are going to do with your personal data in this Privacy Policy.
  • We include a link to this Privacy Policy in the registration process on the Site.
  • We ask you to read this Privacy Policy to ensure you are happy with the way that We will process your personal data.
  • You have the choice to configure your communication preferences.

You remain in control of the personal data you share with Us and you can:

  • Change your preferences  via the ‘Settings’ option for Opt-in and communication settings at any time by choosing whether you want to give consent to your personal data being processed for specific types of communication and / or communication channels.
  • Request to cancel your account at any time and your details and information will be deleted. If you decide to cancel your account, information that is held by a franchisee will not be automatically deleted by Us. Legitimate Interest: We may use and process your personal data where there is a legitimate interest that outweighs any prejudice to your data protection rights.

Legal Obligation: We may use and process your personal data to comply with Our legal obligations, such as identifying you as an individual when you contact Us; verifying the accuracy of your personal data; complying with applicable legislation; and cooperating with the police or a local authority. 

3. The personal data We collect

During the registration process we will collect personal data which may also include special categories of personal data in some circumstances. We will only use this data for purposes related to recruitment.

On occasion, for example where you submit a covering letter, or upload a CV/Resume that contains a personal statement, we may also collect additional information about you, your background, and your motivations for seeking employment.

4. Information collected automatically

We collect data on visits and the visitors to the Site using ‘cookies’ (see Our Cookie Policy for more details). 

5. How we use your personal data

We will only use the personal data that you provide for the following purposes:

 

  1. to provide you with help and advice to assist in your job search,
  2. in order to permit you to apply for vacancies,
  3. to assist in managing the recruitment process,
  4. to keep you updated with new vacancies that we consider suitable,
  5. to provide you with information about general trends in the world of work,
  6. to seek feedback on the Site and our services, and
  7. to support our research into resourcing needs.

We may also collect aggregate information for statistical and analysis purposes, e.g. to understand how the Site is being used.

Where required by applicable law, we will obtain your consent for using your personal data.

6. Disclosing your personal data to other companies or organisations

The only third-parties with whom We will routinely share your personal data will be Subway® franchisees.

Where you elect to submit an application to a particular Subway®store, your personal data will be shared with the Subway® franchisee that operates that Subway® store.

There is also a function within the Site to enable Subway® franchisees to search and access CV’s of candidates, with a view to contacting them in relation to potential employment opportunities.

Your personal data will also be processed by our platform hosting and website development partner Tribepad Ltd who assist Us in running the Site.

On occasion if We suspect that the Site is being used for unlawful purposes, or should we receive a request for assistance from a law enforcement agency, we may share personal data with the relevant law enforcement agency.

We will not share or sell your personal data with other third parties for different purposes without your prior consent.

7. Your Rights and Choices

Under the General Data Protection Regulation (GDPR) you have a number of rights in relation to your Personal Data. A summary of these rights is as follows:

  • The right to insist that companies who hold your personal data are fair and transparent about how and the manner in which they process and use your personal data.
  • The right to access your personal data.
  • The right to insist that companies correct any mistakes in the personal data they hold about you.
  • The right to erase or delete your personal data in certain situations.
  • The right to receive a copy of your personal data held by a company, in certain situations.
  • The right to opt-out of direct marketing.
  • The right to object to automated decision-making processes which significantly affect or disadvantage you, in certain circumstances.

  • The right to restrict the way that companies process your personal data, in certain circumstances.
  • The right to data portability.

 In circumstances where your data has been shared with a Subway® franchisee, as an independent data controller, should you wish to exercise these rights then you should contact the franchisee. 8. Storage and Accuracy of Personal Data

Where we Store your Personal Data

The personal data that We collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”) as long as it is in a country which has been assessed by the European Commission as having an adequate level of protection for personal data. Alternatively, we will ensure that any transfer of your personal data outside of the EEA is in accordance with GDPR and such other data protection legislation as is applicable.

We may store and process your personal data through third parties that We use to operate the service that We provide. We take all reasonable steps to ensure that your personal data is accurate, up-to-date, complete, relevant, and not misleading. You may re-visit the Site at any time in order to update your personal data.

9. Retention and Deletion of Personal Data

We will retain your personal data for as long as necessary to fulfil the purpose(s) for which it was collected and to comply with applicable laws and your consent. Thereafter we will only retain personal data for as long as we are required to either due to the nature of the processing, or in order to enable Us to comply with a legal or regulatory obligation to which We are bound.

We strive to act in accordance with all relevant data protection legislation at all times.

If you have a concern or complaint about how a Subway® franchisee has used your personal data, in the first instance we would ask that you make contact with the franchisee directly, and if unsatisfied at that point notify Us by contacting the Support Desk at support@ipcemea.org so that we can attempt to resolve the matter.

You have the right to make a complaint to the data protection regulator in your country, you can find the contact details for your local Supervisory Authority here: https://edpb.europa.eu/about-edpb/board/members_en. You may also contact the Information Commissioner’s Office (ICO) (www.ico.org.uk)  in the United Kingdom, who We have designated as Lead Supervisory Authority.

Referrers

IP addresses are automatically gathered by Our web server. Your IP address is a number that is used by computers on the network to identify your computer so that data (such as the web pages you request) can be sent to you. You will not be personally identified from this information. Your IP address may also be used to assist in the detection of fraud and We may pass this information to the police. Environment variables We gather include time, type of web browser being used, the operating system/platform, and CPU speed.
